You agree to this by ticking its boxes the first time you sign in to the console, or when you pay for a plan.

End User Licence Agreement

Malva Live · in effect from 3 November 2026

1. Who this agreement is between

This agreement is between you and Aziel Preciado, operating as Malva Live, of Sherwood Park, Alberta, Canada ("Malva Live", "we", "us").

"You" means the church or other organization that installs Malva Live or pays for it. It also means each person who uses it for that organization, including volunteers and remote operators. If you accept for an organization, you confirm that you have the authority to do so.

"The Software" means the Malva Live app, the desk it installs on your Mac, the console in your browser, the relay service at mix.malvalive.com that connects them, and every update to any of these.

You accept this agreement when you tick the boxes in it, pay for a plan, or use the Software. If you do not agree, do not install or use it. Anyone using the Software must be old enough to make a contract where they live, or be using it with the permission of an adult at your organization.

2. Your licence

We license the Software to you; we do not sell it. While your plan or free trial is active, you may:

This licence is non-exclusive, and you cannot transfer it without our written agreement. It ends as section 11 describes. We keep every right we do not give you here.

3. Plans, free trial and payment

Plans are billed monthly in Canadian dollars at the price shown when you subscribe, plus any tax we must collect. Stripe takes the payments, and we never see your card number.

Section 7 explains what a lock does.

4. What you may not do

Part of the Software reaches your Mac as readable source code, because that is how it runs. That does not make it open source, and it stays under this agreement.

You may not:

5. Accounts and who can reach your desk

You are responsible for your accounts, and for what anyone you let in does at your desk. Keep your passwords and console passphrase private, and tell us at once if one gets out.

These people can reach your desk through the relay:

Mixing by a Malva Live engineer is a separate service, and its terms are agreed separately.

6. Your work and your music

Your projects, presets, recordings and messages stay yours. You give us only the right to store and pass them along as needed to run the Software.

The Software itself, including its name and logo, stays ours. If you send us an idea or suggestion, we may use it freely and owe you nothing for it.

You are responsible for having the rights to what you mix, record or stream. That includes music, video and anything else you did not create. Streaming worship songs usually needs its own licence, such as one from CCLI, and Malva Live does not provide it.

7. Updates and locks

The desk runs in the background on your Mac and starts when you log in. It needs the Mac's microphone permission to hear your audio interface.

8. Privacy and other people's software

Our Privacy Policy explains what we keep and why.

The Software includes open-source parts. Each is covered by its own licence rather than this agreement, and they are listed at mix.malvalive.com/open-source.

The Software also depends on macOS and on services run by others, including Stripe, DigitalOcean and Cloudflare. We do not control them.

9. No guarantee

The Software is provided "as is" and "as available". To the extent the law allows, we exclude all warranties and conditions, whether express or implied. That includes any about quality, fitness for a particular purpose, or uninterrupted or fault-free operation.

A live service depends on many things we do not control, including your Mac, your audio interface, your internet connection and third-party services. Any of them can interrupt a service, a stream or a recording, and so can the Software.

So you agree to:

10. Limits on liability

To the extent the law allows, our total liability to you for everything connected with this agreement is limited to the greater of CA$100 and what you paid us in the 12 months before the claim.

To the extent the law allows, we are not liable for indirect or consequential loss. That includes a missed or interrupted service or stream, lost recordings or data, lost donations or income, damage to your equipment, and harm to your reputation.

These limits apply however the claim arises, including in contract or negligence, and even if we knew the loss was possible.

You agree to cover our reasonable costs if someone makes a claim against us because of what you mixed, recorded or streamed, or because you broke this agreement.

Nothing here removes a right the law says cannot be removed, including rights under consumer protection law.

11. Ending this agreement

You can end this agreement at any time by cancelling your plan and removing the Software. Dragging the app to the Trash and emptying it removes the desk once nobody is using it.

We may suspend or end your access if you break this agreement or stop paying. If we stop offering Malva Live altogether, we will give you at least 30 days' notice where we can.

When this agreement ends, your licence ends and the Software will no longer go live. Your projects and presets stay on your Mac, and removing the Software leaves them in a folder called "Malva Live — your mixes". The Privacy Policy covers what we hold on the relay.

Sections 6, 9, 10 and 12 continue after this agreement ends.
